good evening eevrybody here and thanks in advance for reading my issue:
am a lebaneese guy and i have been in denmark twice by a tourist visa visiting my brother there.i just got a my third tourist visa again to denmark and i want to go to sweden and be married to my polish girlfriend.my polish girlfriend has been living in sweden for 3 years now and right now she is studying and working .my questions are:
1-can i get married in sweden to my polish girl-friend even if she has neither permanent residence nor swedish citzenship?
2-will they allow me to get married in sweden even though i obtained a visa to denmark as the first enrty?
3-if i have the right to be married in sweden shall i prove that we met eachother before ?
4-shall i give them a proof that am single i mean that i have never been married before?
5-can we apply for family renufication in sweden under european union laws or swedish laws?
6-to apply for family renufication in sweden under european union law shall we go to poland and live there together first or we can apply directly in sweden ?
7-if my visa is expired do i still have the right to get married in sweden or i should get married before it gets expired?

1) Yes.

2) Yes.

3) No.

4) Yes you must obtain proof of that from your home country.

5) European Union (EU) rules.

6) Your can join your EU-citizen spouse in whichever EU-country, she currently reside. Thats the whole point of the free movement in EU. If she was forced to go back to her own country, just because she has married a foreigner, free movement would not exist.

7) Yes you can get married in Sweden with an expired visa. But you can also get arrested by swedish police and deported. So its not recommended to exceed your visa. Much better to go back to Lebanon and apply for a new visa. You can combine it with getting the papers from Lebanon, which you need to get married. Then you get married and apply for EU-residence card, when you visit her in Sweden next time.

thank you sir for the useful clarifications
1-do you know any website where i can find the general conditions of applying for family renufication in sweden under european union laws?
2-can i stay in sweden during the period of studying my application untill i get an answer or i should leave sweden if my visa is expired even if we apply for family renufication before it gets expired?
3-does it take a long time to get an answer?
4- do they require from the woman to be working or do they ask for a big amount of money in the bank ?

4) She need to be either a worker, a student or a self-sufficient person

Dear fundiver199,

The EU website you provided on your last post was very useful for me. However, it is confusing me a bit about the waiting time mentioned in the swedish migration website compared to what it says on the EU website. On the Swedish website it says the waiting time now is up to 12months for new paper applications for family member of nordic citizen. On the EU website it says as a non EU citizen i have rights and one of these rights is that the application result should not be after 6 months.

From the EU website :-

Your family members who are not EU nationals have EU rights too
Irina is German and lives in the United Kingdom. Her Russian mother applied for a residence card in the United Kingdom, for which she was required to hand in her passport.
The British authorities told Irina that issuing the residence card could take up to 1 year. Irina's mother was worried that if she couldn't get her passport back in time, she wouldn't be able to go to Russia for Christmas, or be allowed back into the UK afterwards.
In fact, the residence rights of non-EU family members mean that the British authorities had to issue a residence card within 6 months and could not keep the passport during that period.

I have an application under EU rules and i applied on the end of July this year and they have just updated the waiting time on the swedish migration website to one year. I called them and ive been told that hopefully my application is on the 6months frame but they're not sure.
What should i do??

with my application i provided everything and i think i meet all the demands, I'm about worried about the demand of that my spouse needs to show that she can support us.

i applied for social security number and they asked for the same papers and i got my social security number.

so my questions are:

1- should i call them and tell them what it says on the EU site that it shouldnt be more than 6 months or that would be idiotic behavior telling them you are wrong of some sort. offensive maybe

2- should i keep worrying about the application even if i got social security number under the same demands (supporting, EU blue card, etc)

The EU claims that applications must not be more than 6 months to be processed. Sweden on the other hand, claims otherwise. So this is a legal battle between Sweden and the EU.

In any case if you have already obtained a Swedish personal number and been registered with an address in Sweden, you don't really have much need for a residence card, except if you wish to travel outside of Sweden. But in any case, patience seems the only medicine to recommend at this time.

I agree. I need to stop worrying because it feels like it's pulling me down. But patience is the only key for now.

Dear fundiver199,

I just wanted to know because you were stating that it is possible to get married in sweden without any legal status but then you were also say swedish police could also arrested and deportated someone whose visa expired eventhough they are married to an EU citizen? In what reason that could happen? And how big is the risk? Because that is my situation atm as i ever posted & asked questions about it........ What causes that and how to solve it if its happen? Because otherwise me and bf should find another solutions for us since apperently all way are closed :/
