Aupair+Marriage+Family Reunification
Hi,I found this link maybe i can have an answer or get any idea of what's troubling us now.
I am a danish and planning to marry a filipina now recently an aupair in Norway, and she were finishing her contract on start of May next year.We are planning to get married by november when everything was arranged. And what's troubling us are,how I can apply her under Family Reunification for her to stay in Denmark.Do i have to put in a bank a collateral as i what i have read in nyeidenmark rules? Not so sure of this, because some of the couple i have known in the same situation they said that they did not do that as they are exempted to do so if you have kids,I have kid too under 18years old and one thing is i am a pensioner.Looking forward if you can give me an answer regarding this matter.
Thank You

Re: Aupair+Marriage+Family Reunification
To get dispensation from the 51.000 DKK deposit, it is not enough 'to have a kid under 18'.
A person who is the parent of a child, who is living with him/her, and whose co-parent has the child visit (stay overnight) on a regular basis at least every second week-end,
- OR a person who has a child not living with him/her, but has the child visiting on a regular basis at least every second week-end,
- OR a person who is the parent of a child, who has grown up in DK and is at least 6 years old and is living with him/her,
may be entitled to dispensation from the 51.000 DKK deposit.
If you do not have your child visiting you regularly, there is very little chance that you will get dispensation.

Re: Aupair+Marriage+Family Reunification
Yes there should be, since this arrangement could not be maintained, if you moved to Philippines to live with your wife there. If the mother of your child is living in Sweden or Denmark should not be important, because the two countries are so close to each other.
It would be different though, if she was living in Finland, and your wife was from Russia. Because then it could be argued, that moving to Russia would actually make it easier for you to see your son and not more difficult.
