Tourist visa and sponsoring

Hello,

I want to invite my younger brother and sister to come to Denmark to visit me in December. Every expenses and costs are on me. I've already done the online invitations for both of them. Everything regarding the supporting documents appears to be ok (i believe), including my payslips for the past 4 months, copy of passport and residence permit, etc.

However, I'm still a bit concerned about the likelihood of their applications being turned down due to a number of reasons. First, they are still going to university and have no income, nor any properties in Vietnam. Second, both of them are single and literally have no attachment to the country. Therefore, I'm worried that the embassy probably would reject to grant them visas, given the fact that there is no proof that they would come back (even though it's not the case).

I would like to hear what you think from your professional point of view. How likely will they grant visas to my brother and sister, provided they are fully sponsored by me?

The EMBASSY cannot refuse to give visa, if they are in doubt, they have to send the applications to be processed in DK by the udlændingeservice.

As one can invite one's siblings, it is reasonably likely that they will get visa. But you will really only be able to find out if your siblings apply. Nothing ventured, nothing gained :wink:

Being enrolled at a university study is for sure also "attachment", because who in his right mind would give up their study halfway to become an illegal immigrant in another country? So they should enclose proof, they are already enrolled for the next semester, and that will then be just as good as having a regular job.

Thanks a ton again to Mh and Fundiver for your advise.

Today my brother and sister came to the Consulate (who will then forward the applications to the embassy located in another city). They were told that their applications would definitely be turned down if lodged because they don't have any proof for necessary means to cover the expenses during their stay in Denmark.

I dont understand. It doesnt make any sense to me since they're fully sponsored, all expenses will be covered by me (which is clearly stated in the applications and invitations), yet were asked to provide financial proofs. Therefore, the one who should provide proofs is me, not them, right? They are still going to school, have no regular jobs. How could they provide any financial means?

As you said, the embassy is not authorised to turn down the applications. Any refusals should be decided by US. I'm planning to call the Immigration Services here now to ask but still want to share this with you.

I'm so devastated and worried.

Just forget it. The employees at that embassy are wrong. Again. ÆUG know the visa policy of Udlændingestyrelsen well, so you don´t have to call them and ask about this. But if it makes you feel better to call, then of course that is fine. Just be prepared, that they are not allowed to say anything in the phone, that can be enterpretated as a "promise", that the application will be approved.

Thank you. So should I tell my brother and sister to keep on applying despite what they are told by the employees at the Consulate?

In case they receive the refusal decision, what am I supposed to do?

Also, could you please let me know what you think regarding their requirement of financial means from my brother and sister?

Since it's you who is going to pay for your siblings' visit, it's you who should provide the documentation that you're able to provide for their stay financially. So you should give a copy of your "årsopgørelse" or monthly pay-slip to them so they can hand in these documents along with their application.

Anything else is purely Vietnamese employees being envious that your siblings have someone living abroad to help them. Just ignore that.

Thank you Skaanebo. I've already enclosed my payslips of the last 4 months, along with other required documents for a sponsor.

I've just talked to someone from Immigration Services in Copenhagen about this matter. She said that it was actually up to the embassy to ask for any documents that they believe to be sufficient to make the decision!! She also said it was possible for the embassy to turn down the application :shock: .

I think i will tell my siblings to just apply and we will take from there.

I agree. This is quite common in low income countries, where the local employees at the embassy are unable to travel abroard themselfes because of their financial situation. And thus feel very jealous against those, who have found a "sponsor". A bit like some girls will feel very jelous against other girls, who have found a "rich" foreigner to marry.

The local philippine employees at the norwegian embassy in Manila were "famous" for treating the users of the embassy like complete shit. Often people were seen crying, when they left the premises. But reportedly it has improved a lot now.

The embassy can ask for any documents, they want. And if they are supplied, the embassy can them issue the visa themselfes without asking Udlændingestyrelsen.

But the embassy can still not turn the application down. They can only refuse it, if it is incomplete ie. because the applicant don´t have a valid passport or havn`t paid the application fee or provided a passport picture. Or they can forward it to Udlændingestyrelsen, who can then turn it down.

It seems like you are being told a lot of rubbish information all over the place. So maybe better to just stop asking people, who don´t know, what they are talking about, and who are not the ones to make the decision in the end. And instead follow the advice and correct information, you are given here.

Thank you very much for the responses. In spite of reading thoroughly the regulations and rules on Newindenmark.dk, I'm still easily shaken by the information given by these people. The authority and power are on their hands, though :)

I will tell my brother and sister to send the applications anyway. Let's see what will happen.

Just for the record: The "someone", you talked to from Immigration Services in Copenhagen, is NOT a person responsible for processing visa applications. It is an employee at the service center, whose sole responsibility is to answer phone calls and receive applications, but not to process them.

So even I am sure, they try their best, they just don`t have the same level of knowledge about the law and practice as those, who are employed to process the applications. And they also don`t have the same level of education, because its to expensive to hire people with an acedemic degree in law for that kind of routine work.

If you want more qualified answers, you will have to write an email to US and wait, until someone has the time to answer it. You can not expect to always get 100% correct and complete information in the phone. And sometimes the problem is also, that even the information is correct, maybe you misunderstand it.

Maybe the person at Udlændingestyrelsen tried to explain you, that the embassy could refuse the application, if it was incomplete. But you took it to mean, they could turn it down, which is legally something else and different.

Just to a quick update to those of you who are interested in the case.

I wrote an email to US and got their reply (exactly as told by Fundiver :)), in which they confirmed the same as you said too :). But there is a point in the mail that is questionable. It says 'If the Embassy requests further supplementary documentation in connection with the case, which the applicant cannot/will not/is not able to submit, the embassy will most likely submit the case to the Danish Immigration Service for processing.* In that case, the embassy would send it to US only if they accept the application without the missing document that they ask for (which is not my siblings' case by the way).

However, since I dont want to processing time to be extended in any way, my siblings managed to get the financial proofs in the form of bank saving account (transferred from my mum's). Today they called the Consulate to ask if it's ok to come to submit the application which is now completed and fullfills their requirement. The Consulate said they must wait for 2 more weeks before they are allowed to send the application. Or they must go to another place (3 km away from the Consulate) to submit with an extra fee of 50 USD.

To be honest, I was and still am in shock and horrified by that. How on earth can this happen? The degree of corruptive bureaucracy and vile attitude of some individuals at the Consulate is beyond my words :shock: . I read on the embassy's website and nowhere can be seen such rule of waiting few weeks before one can come to apply for visa. The thing with making appointment in advance is already a bit ridiculous. But this is totally wrong.

If my sibling are asked to wait for a month or so before coming back to apply, there is nothing they can do as long as the Consulate/ embassy doesnt accept to receive the applications.

My husband is going to write to the senior officer (who is Danish) in the embassy to make a complaint about this. I hope at least he's not as corrupted as his employees.

You did the exact right thing the whole way around. I hope, the visas will be issued soon, and that they enjoy their visit to Denmark :-)
