Moving to Sweden is our only hope to be reunited.

In behalf of my husband, We would like to extend our heartfelt thanks to all Æug friends who will join on giving us pointers in our situation. Thank you so much.

Story: My husband and I seek some advices few months ago regarding our situation. But sadly to say we still both broken hearted on finding a solution to be reunited again.

My Danish Husband Jesper and I (Anna) applied a spouse visa and got rejected. The reason it was rejected because 3 years back history, he was been receiving help from the kommune.

Then the immigration sent me home in my own country.

From my home country I applied a student visa back to Denmark and expected assumingly that my request will be granted since I got admitted from school and paid my tuition fee. Bu then again,, the immigration once again rejected my student application ,, They refuse to give me a visa because they said that my main goal is not really going to study, instead I have my own agenda. And also they talked some other stuff too why it was rejected.

We both decided that he will move to Sweden as soon as possible. (We got this idea moving to Sweden from our previous post.)

Denmark:
1.He will completely give up his apartment? No more address in Denmark?
2.He will report to the kommune his moving in Sweden?

Sweden:
1. Is it allowed to live in Sweden and can still work in Denmark? He have a steady job in Denmark now. But he is willing to take the train back in fort everyday from Sweden as home address to Denmark as work place, Is it possible?
2. How many months we should wait before we can apply a spouse visa for me?

Asia:
1.) Im here in Philippines now, should I go to Thailand Swedish embassy to apply?
or I can apply in the Norwegian Embassy here in Philippines?
or its up to me where to submit my application?
2. What are the requirements should I provide? is there some links?

He should either sell it, rent it out or terminate his contract, if it’s a rented one. First its hugely expensive to pay for 2 apartments at the same time. And second it might cast dought on, where he actually live, particularly if the danish apartment is more near to his work.

2.He will report to the kommune his moving in Sweden?

He only need to report his address to Skatteverket in Sweden. They will tell the danish kommune.

Sure. There are 10.000´th of Danish and Swedish people, who commute to work over Øresund each day.

2. How many months we should wait before we can apply a spouse visa for me?

There are two ways to do this:

1) Apply for family reunification (or “spouse visa” as you call it) after Swedish rules
2) Take advantage of the right to free movement in the EU for union citizens and their spouses

In your case I will strongly recommend the EU-rules, because your husband has work and easily meet the financial requirements in those rules. And the problem with Swedish rules is, that you need to apply from Philippines and wait there. And currently the waiting time is very long about 9 month.

So what you do is, that you apply for a Schengen visa to Sweden, as soon as your husband has been registered in Sweden. Or you apply for a Schengen visa to Denmark, when he is ready to move there, provided you have already been outside Schengen for 3 month at that time.

Then when already in Sweden you apply for a residence card after EU-rules at Migrationsverket and wait patienty for them to issue it. This can unfortunately also take quite a long time. But in theory you have all rights in Sweden, as soon as you set foot there, and the residence card is only to comfirm this. And at least you can be together with your husband and not 9.000 km away in the Philippines.

The Norwegian embassy in Manila can process applications for Schengen visa to both Denmark and Sweden. So it would be a complete waste of time and money to travel to Thailand just only to hand in the application at the Swedish or Danish embassy there. But if you really want to, it is possible to do it. It just makes no sence at all, unless you are going to Bangkok for some other purpose.

2. What are the requirements should I provide? is there some links?

When you want to apply for residence card in Sweden, you should bring a legalized copy of your marriage certificate, if you were married in Philippines. If you were married in Denmark, this is not necessary.

But other than preparing a bit by reading information about your future application for visa and residence Card, the thing, that will really bring you further now, is, that your husband find a place in Sweden, where you can stay.

That is the only real obstacle in the proces, you want to start. So thats what you need to focus your entire attention on for now.
