Me ( Jesper) and my wife Anna would really appreciate all your help regarding our status.

I meet my wife Anna here in Denmark while she was working as AUpair, We got married last year and now trying to fix a SPOUSE Visa for her so that she can stay in Denmark,, The problem is,, According to DENMARK LAWs of family reunification I am not qualified at this moment to apply a FAmily Reunification since I am JOBLESS for a while now and accepted a help from the Kommune. Which is a Big NO when you apply a Family REunification.

I heard ideas going to SWEDEN and to apply a EU LAWs, (something).. I also heared about the Slesvig-Sverige reglen but that is an artikel from 2005 so I am not sure if it is still valide.

Our wish is to remain here in Denmark if it were possible, but if no other solutions then we will be forced to leave Denmark. Not precisly our first choice.

ME and my Wife will really appreciate your head ups about what we are going to do, So that we can be together and no need to be apart.. Please help us to give some ideas on how to get through this.

Be aware that since you don't have any job, it is not so easy. If you can find a job in Sweden it will be 'a piece of cake' to use the EU-rules.

If you can't find a job, and you don't have big money in the bank, you cannot make use of the EU-rules.

You may still move to Sweden and your spouse will almost certainly get family reunion when she applies, BUT unless she has a valid residence permit in DK now, she will have to go back to her country and apply from there. It will then take some months, but since it will enable you to live together without worries over her residence permit, it should be worth it.

I just thought to update my status here with my husband.

My Husband and I got rejected when we applied our spouse reunification in Denmark. The immigration given me 5 days to pack my things and return to my own country. It was totally chaos since we never really expecting it to happened.

Going to Sweden wasn't clear enough how we are going to do it. So I went back home in my own country.

We appeal our case but it was rejected again.

I went back in Denmark using student visa now. Though its very expensive.

My husband and I still on the process on getting me a permanent visa since having a student visa is only temporary and expensive too.

The laws in Sweden are quite liberal and it's very easy to obtain a residence permit there so how it can't have been clear is beyond my comprehension.

You can save yourself the costs of paying tuition by moving to Sweden. As you now live in DK, all your Danish partner needs to do is actually to move to Sweden. You can then remain in DK until the Swedish permit has been granted. This will also entitle you to free education in Sweden. If you can prove that you have been cohabiting for the past 2 years you may even qualify to get a permanent residence permit right away. With a permanent residence you can even get the Swedish study grant.
