Background:

My boyfriend is from Nepal. (I am writing this in English, so that he can read it too)
He has been married before and has a 6 year old child. His divorce has not gone through until recently, so papers shows that he has officially been married until early January this year. His child lives with his exwife in Nepal.

We met in September last year, and spent looots of time together during my stay. After that we have met in skype very often. I used to have fears about his intentions, as there are many bad visa- stories out there, but I like him and decided to trust him.
I am Norwegian, but have been living in Denmark for 15 years. I have a permanent job and a permanent rented apartment.

Current Situation:

We are in some confusion about what to do and how. The main thing is that we want to be together and get settled, soon and forever. But how do we get there?
Eventually we decided that I will I invite him to come here on a schengen visa, in February or early March. While he is here we get married. Then we apply for family reunion through the EU rules. (This is an advice I got from this board, see my previous post in danish)

Questions:

1. Should I write in the schengen invitation letter that he is my boyfriend, even though he was divorced in January 2013 and I haven’t met him after September 2012? I want everything to be as true as possible, and this is the truth, but I am thinking it might look suspicious in formal papers. Would it be better if I invite him as my friend?
2. Does it matter for the authorities (good or bad) that we might get married when he is here on a schengen visa? (He will bring documents for this purpose) I was thinking to write in the invitation letter that the purpose of his stay is that I want to show him my country and my culture, and that another purpose is of course to spend time together as a couple. (If I invite him as my boyfriend)
3. If we get married during his schengen-stay, can we then apply for family reunion visa before his schengen visa expires?
4. How long is the processing time for a family reunion visa? Can we risk that he has to go back to Nepal and stay there for a looong time, while waiting for some answers?
5. Do I have to show bank info for making a schengen visa invitation? Which are the requirements? There is no such question in the invitation form.
6. Which documents does he need to bring to get married here?
7. Anything else? Any traps we should be aware of? Personal, similar stories you want to share?

I am thinking that if this schengen thing does not work I can go to Nepal in march, because then I have some holiday. And we might get married there. Any advice? Any possibilities we forgot to think about?

Dear Nepal

Please respect, that this is not a hotline service, where paid employes sit ready to answer any question, as soon as it pops up. So sometimes you will get a quick answer, but other times you need to wait, until someone see your question and also feel, they have something to contribute with.

1) You can only invite him as your boyfriend, if you have physically seen each other within the last 12 month. This is a general condition in the danish visa practice. If you fullfill this condition, it is definitly best to invite him as your boyfriend. Nepal is "immigration country without reference limitation", so luckily it is possible to invite him as "friend".

2) No that does not matter, so dont mention it. Also if you invite him as your "friend", it will be conflicting information, that you plan to get married, because you dont marry a "friend", do you?

3) Since you are a norwegian citizen, and Norway in an EØS-country, the same moment you get married, he will already have a right to stay in Denmark as your family member, that is as long as you stay here yourself. You just go to Statsforvaltningen and ask them to issue a recidence card according to the free movement rules of EU/EØS:

4) This question is irrelevant, please read the answer to 3)

5) You can find information on the embassy homepage. Some kind of proff of your finansial status is standard, assuming you will be the one to pay al expenses. Could be a copy of your last 3 pay-slips. Alternatively he can pay himself, and then he need to provide evidence of possession of 350 DKK for each day in Denmark.

6) His passport and proff from Nepal, he is not married there already. The latter should probably be legalized by Nepals foreign department and then the danish embassy or consulate in Nepal. Your danish municipality can clarify further questions.

7) Even he intend to stay in Schengen, he should not say that to anyone, and he still need to travel on a return ticket. Otherwise he will not even be allowed to board the plane.

6. All documents need to be legalized and translated (unless they are bilingual Nepalese + English). English translation will be accepted, it doesn't have to be Danish. He needs his divorce papers. Birth certificate. Also if for example he has changed his name in connection with marriage, he probably should have those documents legalized and translated too.
