Permanent application missing documents

Hi everyone
I had applied for permanent and I had mentioned my case under the name of Hiren, but I can not login due to some password problems.

But I am a student and I had applied for permanent in july 2012. I had filled in form TU 4 and elso given all mentioned documents to US. I have VISA as student untol march 2015.

I got a letter yesterday that I am missing document that had to submited along with TU4. This document is the extension of my visa, but I dnt know which document should I fill up and submit. The requirement is as per following paragraph.

"Man bør derfor også udfylde et ansøgningsskema om tidsbegrænset (midlertidig) forlængelse. Det bør man gøre, selv om ens tidsbegrænsede (midlertidige) opholdstilladelse først udløber på et senere tidspunkt. Man benytter det forlængelsesskema, som passer til ens nuværende opholdsgrundlag, fx opholdstilladelse som lønarbejder eller studerende"

Can someone please tell me what form should I fill up and send to them.

Thanks for your reply. The same is my question. Why are they asking me to full fill extension of visa form when I have visa until march 2015. They did not even see my application, and without looking into it, I was sent this kinda warning letter with deadline.

So should I call them explain I have visa until 2015 or should I just submit the extension of visa as student form? They also stated that your handling time would start all over again when I submit this form.

I will just do that then. But its written in letter, that if the document is not received in 2 weeks, your application would be rejected.

So should I just wait and if they reject it because of this reason, then take legal action filing a complain - is that how you mean.

Thats what they wrote to me. But I stated in permanent form and also attached my current visa showing its valid untul 2015 march.

@jagstrack, it's because of this:

For at Udlændingestyrelsen kan behandle en ansøgning om permanent opholdstilladelse, skal det også vurderes, om man fortsat opfylder betingelserne for den tidsbegrænsede (midlertidige) opholdstilladelse.

It's not because you may have to have your visa extended, it's because they need certain information that they have not incorporated into the TU4, and that information they need is requested on the application for extension. The TU1, TU2, TU3 and FA10 have those questions incorporated on them, so an application for extension is not necessary. But the TU4 is the one you use because you are here as a student.

It was also that way for other permanent applications for awhile, but they have taken our advice and combined the questions on one application for the other four types of permanent residence. Why they have not done it for students I have no idea. Do you, mh or fundiver or anyone else? Is it in the works?

Thanks for your reply. I understand what you mean, so in that case, I should fill up extension form and submit to US. But I should use same case order ID and pay no fees, right?

Also now they would calculate handlings tid from the day they receive my application form for extension, so I would have to wait 1 year more. I wonder if I can do somethin so that they would take into consideration the application time from the day i applied for permanent.

I had called them several times and asked if they needed anything, and reply I got was we miss nothing until this letter was sent, why cant they tell me earlier or even at police station if something is missing. Would save me alot of precious time

They can't tell you anything specific over the phone. They are so swamped right now because of the law changes and a few other things, that it is a waste of time to call them or go to the police station to try to get status on your case.

I don't think you can do anything to get them to change the start of the processing time. I wish you could, but all you can do is just send in the form they need with the same case number, so they know it is you, and I wouldn't think (though I am not 100% sure) that you should also have to pay a fee for extension. If they didn't ask you for more money, I would say don't send them any.

Yes you should use the same Case-ID, and you only need to pay the fee for permanent application, which you have paid already. It is just a case of missing documents, like Psalm12 has explained.

Thanks again for your replies.

I called immigration and I will explain the following for everyone's benefit and understanding.

When I called department for permanent residency and asked which form should I fill up, they explained that I should fill up form ST1. But that form is not for extension, the form for extension is form B, it is what you fill first time when you apply for residency as a student and school should again fill out Del 2 of this form. On the letter it's stated that you have to fill up form for extension. I explained my confusion to which she said that you have to call department of labour and rekrutering.

When I called them, they said you should fill up ST1 as it gives more info about you. They said that you can fill the form, and your institute isn't required to fill part Del 2, just mention on top of form "Extension" and they will themselves find the rest from school.

I am still confused, I know they stated clearly, but since they have been so confusing, I wonder if this is just a diplomatic strategy to play around. That's why I was thinking to ask my school to fill up the form DEL 2 which would take one more week. What dó you guys suggest, should I ask school or do as I was told my labour and rekrutering department?

I can see there's no clear communication between two departments and as a result the applicants have to suffer. It wasted my 7 months.

TU1?? That makes no sense. It states clearly in the preamble to the form that you can only use this form if your residence is based on family reunification. I wouldn't do anything they told me over the phone if it conflicts with what is clearly shown on their website. What do you say, fundiver???

But ST1 doesn't make sense either. You are applying for permanent, not first-time residence. The website says you should use TU4 and form B. Should we trust the website or someone you talked to on the phone?

That's my corundum. The website says something but they ask me for something else. They said form B doesn't give enough information about me, so fill in form ST1.

It's very strange. I don't understand why should I fill ST1 when I have stated all my info in TU4. But when I fill up ST1 it will be sent to department of rekrutering and labor and then they will provide necessary info to me to the dept. of permanent.
