Hi guys, I have read some forums here and I found it very useful for evebody who's seeking for something.. I will be needing your help regarding my risky situation..

I am a filipina living in Denmark. I have worked as an aupair under my legal resident and working permit for two years. My visa got expired last week of September 2012, so I am now an illegal immigrant on the country.
I did apply for the same job in sweden some months ago when I'm still having my visa, but my application got declined since they are not allowing anybody to work for the same position if you have already been on another EU country, as I have known.
I haven't had a chance to find another job on another country after Sweden since I have just very few days left on my visa in Denmark that time.
I have some financial reasons that's why I don't wanna go back to my home country yet. Now, I am trying to find a way how to get a permit to stay, not in Denmark but maybe atleast in Sweden without going back to my home country.
Somebody told me that I can marry someone there and live together under Swedish Laws and I will have a right to stay. I just wonder,

"Is it the only way to be legal again? marrying someone?"

I don't even have an EU boyfriend at the moment so how can I cope up with the marrying thing, duh.
I do know somebody who like me alot here in Denmark and an EU citizen but I don't think he will agree to marry and move to sweden just for my situation.
Paying someone to marry me? it's negotiable but that's LOL for me too..

Well you have put yourself in a very bad situation.

You cannot apply for any kind of residence permit in denmark as long as you are not staying legal in denmark, and most countries actually requires you to apply for residence permits from your home country. this that Denmark has, where you can apply when in the country is actually a "service" that Denmark provides...Sweden does not provide that as an example.

You did the worst thing you could have done for yourself, when you overstayed your residence permit. So yes...Your options to stay legal is limited to finding a Eu citizen to marry, that are willing to
1) move to another EU country for a period of around 6 months at least, to be able to benefit from the rules as a travelling EU citizen.
2) Is willing to marry you on a performa basic, putting himself in risk of being fined, or in worst case imprisoned for fraud if it is found out.

This is not very helpfull to you i know, and it is most likely not what you where hoping to hear, but your options an an illegal imigrant in the whole Schengen area are VERY limited.

Another option would be to go home and then find an au-pair position in another european country than Sweden. Its not all countries, that have this policy of ruling out applicants with previous au-pair experience, and it is quite common for au-pairs to move from Denmark to Norway or the other way round. So finding a family in Norway might be an option for you. But Norway will surely not accept an application from someone who is here illegally, so you need to apply from the Philippines at their embassy in Manily, once you have fould a family already.

There is no future in being illegal in Europe, and really there is also no future in trying to marry someone just for the sake of getting a residence permit. After all you are going to live with that person for a number of years.

Please note that your previous au-pair family is obliged to pay for your transport home. That is part of the contract.

I truly understand what u mean guys and I'm aware of the consequences that could happen during my illegal stay in EU,
I just don't wanna go back home to my country yet, I am also thinking it will be the same way around- when I exit Denmark voluntarily or get caught and be deported back in my home country.
once i plan to exit denmark, I can get a stamp on my passport proclaiming that I can't go back to any Eu countries within 3-5 years for staying ilegally in Denmark. So- I could have just earned some money (from black jobs that every other legal aupair are doing) during my illegal stay here and surrender when I decided to go back to my home country, then I still can get that same stamp lol.

Anyway, regarding the marrying thing, I, myself is not so happy as well with that fraud marriage.. but somehow, if I can find someone who is willing to take a responsibility for me and the one I could fall inlove with in a short time- (who knows) for moving in sweden and marry me there, do you think everything will be fine again?

Just so you are aware that it DOES matter if you leave the country on your own or if you are "kicked" out.

If you leave on your own you will be prohibited to apply for a visa to Schengen in up to 5 years, but you can still apply for residence permits. If you are "kicked" out you can be banned entry in Schengen for up to 5 years, and will therefore not be able to apply even for residence permits.

And in particular if your overstay is relatively limited in duration e.g. a few weeks or even month, this will not necessarily be regarded as a big deal, if you left voluntarily and now apply to become au-pair in e.g. Norway. If it was several years however, Norwegian authorities might be hesitant to give you even a residence permit out of fear, that you will also just stay in Norway, when that expires after e.g. 2 years. So it DOES matter, how big you make your offence, and you stand to gain absolutely nothing by making it bigger, than it already is.

As for finding a partner to marry, if you really want to pursue this route, there are several online dating portals for western men seeking love and marriage with asian women. So why not sign up to some of these? And if you find someone, then he can visit you in the Philippines, and if it works out, you can then get married and transfer to whatever country, he is from.

One of my best friends found his wife this way, and they now live a happy family live with a small boy in Sweden. So there is nothing wrong with this, just don’t see it as a way to avoid leaving Schengen and go home to your own country for a while, as - just for starters - you cant rush love.

Its not “the end of the world” go to home, and you can always go somewhere else – or back to Denmark – at a later point, when you have a legal foundation for doing so. Many philippinas work as domestic helpers in countries like Singapore or Middle East, so why not look at such opportunities as well as au-pair?

Since your English is good, you may consider looking for an au-pair job in Turkey - it is not very difficult anymore to get a residence permit if you are working as a nanny here (there is no official au-pair organisation).

The salary is not the same as in DK, on the other hand there is no limitation of how many hours you may work, and of course since it is not really organized on au-pair terms there is no obligation of the 'cultural exchange', so your host family can be non-Turkish. (there are some private organizations, but only for English, Canadian and American citizens as far as I can see)

I DO NOT know any au-pairs here, but on the last link you can find others who are working/have been working in Turkey. Concentrate on Ankara, Istanbul and Antalya, where there is a chance to find other Filipinos.
