Tourist visa, Marriage & Family Reunification

Hello Everyone,

I have a lot of question concerning the terms on a tourist visa, getting married in Denmark and applying permanent residence on the ground of Family Reunification.

I (32 y/o Filipina) meet my boyfriend (Dane) two years ago through an online dating site. We've been visiting each other's place since then. He flew to Singapore five times and I fly twice to visit him in Denmark.I will be visiting him on December 2015 for the third time. Upon my stay, we are planning to get married and apply for family reunification.

As I read through the blog I understand that I can apply for permanent residence on the grounds of family reunification. My concerns are the timeline.

Can I apply for family reunification right after we get the marriage certificate or I need to wait for at least a month before the expiry of my tourist visa to proceed?
My tourist visa will expire on April 2016 when is the best month I can apply is it January, February or March?

If we are to get married can I process the requirements for marriage before coming to Denmark and bring it along during my trip? or will the Danish Immigration prevent me from entering Denmark?
(PS: As I am a Filipino I am referring to Certificate of No Marriage (CENOMAR) authenticated by the Department of Foreign Affairs Philippines).
For a Filipina, can I use the DFA Authenticated CENOMAR or I need to undergo document legalization at the Royal Danish Embassy, Manila?

For Family Reunification, what are the chance of getting approved if my passport is about to expire on December 2016.Will this be a ground for rejection?

Upon submission of family reunification can I then apply for a higher education in one of the university or I need to wait for the result of the application before proceeding with school application?

And lastly if I fulfilled all the requirements together with my spouse is there still a chance of me getting rejected on a specific reason/cause of rejection other than the requirement? will the case of us, meeting online be one of those?

I know its quite a lot to take, but Thank you in advance for your help.

You cannot qualify for a permanent residence permit on your first application. You will be given a two year residence permit which can then be renewed every two years until you qualify for a permanent residence permit.

From my Experience( Non- EU but not from Fillipine) yes you can, but you have to have all the documents with you i.e your birth certificate, your valid tourist visa, Certificate of No Impediment( from your home country this should be from the foreign affairs office) and its a certificate to show that you are not married anywhere else, if you were then you should have a document showing you divorced or if you were married before and he died you then have to have a death certificate. once you here ensure that the marriage takes place before the expiry date of your visa ........ ( if the marriage is in church then you have to take those documents to your kommune which in alliance with the church they will book a day for your marriage, after the marriage you can take all the documents( your marriage certificate, house documents, passport copies) and the forms- you have to fill forms from http://www.nyidanmark.dk/en-us/coming_t ... cation.htm then take them to immigration or the police places choosen on the link above when you have done so you are therefore entitled to stay back as you wait for your reply which depending on the case some take longer or short periods to get back a letter of confirmation saying now your husband has to put money in the bank for your security.(Bank guranteee)


N/b the application can be rejected if you passport is only left with 3 months before expiring . read the above link to get and understand all the required things

YES i agree the permanent residence comes after 5yrs( if you meet all the requirements)http://www.nyidanmark.dk/en-us/coming_t ... permit.htm) and also be prepared to learn danish language this a must, once you married and have the CPR number then your husband has to go to the kommune where you live to present this and then you will get a letter from them showing which language school you have to attend( danish lessons are free) take note the language is vital before doing anything else but at the same time i have no idea about studying at the university if its in danish then u have to learn the danish lessons til module 6 but if its studying in english then try get some help from your husband he can ask around if this is possible...

Do get your passport renewed before you apply - if your application is accepted, you will only get residence permit for the period until it expires. And given the time-line, your passport may expire before you get an answer!

In any case, your first permit will be conditional of your passing a Danish exam within 6 months.

Hi,

You can apply for a TEMPORARY residence permit on the grounds of family reunification right after you get your marriage certificate , provided you are a legal resident in Denmark. That is, you have a valid visa when you submit your documents at the Danish immigration service. You can apply anytime within the 90-day period since arriving in DK.

You can bring with you the required documents to get married in DK. Have your CENOMAR authenticated by the Department of Foreign Affairs (DFA). Your CENOMAR must be not be more than 4 months old by the time you submit it to the Kommune (where your fiance lives). In my experience, I didn't have my CENOMAR legalised by the Danish Embassy. It was accepted by the Kommune as it was already authenticated by DFA.

As for your passport, it is probably better that you have it renewed. The residence permit that will be granted will usually be for 2 years, but only valid until 3 months before your passport expires. So for example, if you apply for family reunification in January 2016 and the processing time would be at least 3 months, your residence permit will likely be valid only between April - Sept 2016 and then you would need to renew it again so soon.

You can apply for a higher education in a university...but then you will have to pay the full tuition fees. And you will need a student visa for this, since you can't study on tourist visa and you don't have the residence permit yet either. It is better that you wait for the result of your family reunification application and once you have the CPR, then you can study, work or learn the Danish language (for free).

It is not always guaranteed that your application for residence permit through family reunification will be approved. It depends if you and your spouse satisfy all the requirements for the issuance of residence permit. Meeting online won't be one of those reasons, unless of course you have never met your fiance in person yet and your marriage was done via a proxy

Is there a case wherein the passport renewal is ongoing (In case of Filipinos, It will take 6-8 weeks of processing) and while waiting for it I can submit my family reunification application and once the new passport receive I can resubmit the new passport to DK Immigration provided the processing of my Family reunification is still ongoing. Will they consider it or it will automatically a grounds for rejection?

And on the subject of travel insurance, Is it advisable to have a one-year travel insurance or only six months? as I understand it's not guaranteed that I will get a reply for the family reunification application within 3 months it may take 6 months or a year.

Yes it is possible to submit a copy of your new passport (all pages including cover) while your application for family reunification is being processed.

As for your health/travel insurance, only the dates covered by your schengen visa is normally required. I suppose it will be a good idea to have an extended health insurance for while you are waiting for your temporary permit in DK, in case you need it. You wont be covered by DK's health services until when you have the permit and subsequently a CPR number. But it is not really required to have it during your procedural stay. Well, i have not been asked for it.

Just to clarify my previous comment above:

About the passport...you WILL NEED to submit a copy of your passport (all pages including the cover) along with your application for family reunification at the Danish Immigration Services. So, either you renew your passport before you submit your application and when you have it already, then submit your application. Or you use your old passport for the application and then you renew it and once you have it, submit a copy of it while your application is still being processed. I still think renewing your passport before you come to denmark is the best option. Processsing the renewal of your passport at the Philippine embassy in Oslo might take longer than having it renewed in the Philippines...so it is better you have all the requirements ready before submitting your application for family reunification.
