Resident card and Tution fee

Hello

Me and my EU wife got married, I over stayed on my visa for 1 month and 20 days. Can I got to the office with my wife and submit application for resident card without being deported or asked why I over stayed? also know that we are married anyone know if I can study without tution fee? I was told my temporary visa should be yeidling to permanent visa.
