EU-Resident card application submitted from Norway - EMERGENCY SITUATION

Hey everyone,

I am a non-EU citizen, my partner is Norwegian, and we have a child. We are currently in Oslo and i have a schengen tourist visa, issued by a Norwegian embassy, valid until the 1st of January. We have an apartment in Denmark, to which we can move in also from the first of January.

So, in the middle of November, we submitted an application for the EU Residence Card, to the State Administration, by ordinary post and so far i haven't received any answer or notification from the State Administration.

My question is: can i benefit of the Procedural Residence after my visa expires considering that we submitted it the application from Norway? If yes, how?

We are really in affliction because we do not know if i leave on the first of January or something.

Did you send the application as a registered letter? Then, you should be able to see if the letter was received. It's not advisable to send important letters as regular post.

In any case, you can simply move to Denmark and once you are in Denmark either hand in a new application or, if they received it, just wait for the decision. You should inform the authorities of your new address in Denmark.

Thanks for the reply.

Well, i sent it as a regular post...we thought by now we would have an positioning from the authorities. We called them last week and they were not clear about what we were suppose to do. And i couldn't know about my case because i didn't have its number but my girlfriend received a notification to declare she had enough funds to bring her family to Denmark without being a burden for the Danish social system.

Now you use the term "girlfriend". A requirement to use EU laws is that you are either married or can prove that you have been cohabiting for the past 18 months.

Hum, yes...we have lived together here in my country, Mozambique, and here in Norway...and we have a child.

In any case, if your girlfriend received a questionnaire, the process has begun and you're free to move to Denmark provided you fulfill the requirements in EU law.
