query related to child abduction

Hi,

is there any law in Denmark, using which one parent can ensure that other parent can not take the child out of denmark?
I know that in UK a parent can approach the authorities if he or she has an apprehension of the child being abducted by the other parent and the authority can issue a Prohibited Steps Order which means that other parent can not take away the child without court's permission and father's consent. And, if she does so, she will be apprehended at the airport as Prohibited steps order is circulated to all the airports.
i want to know if any such provision is available in law in Denmark?
Experts, please guide.

It depends - a parent with sole custody can decide where the child should live, including whether this should be in DK or otherwhere.

hi mh,

from the link that you have sent me, i am not able to decide whether, my child comes under the category of joint custody or not. please help me to understand this.

1) I married in jan 2006,
2) child born in Sep, 2007,
3) we came to denmark in feb, 2009,
4) wife deserted me and took the child in Oct, 2009.
5) living separated since then.
6) have not seen or spoken to child. (was not allowed). everytime I tried, she said come here.
7) I did not go citing my safety and job security. its easy to trap a man in false cases in the country I come from.
8 ) No divorce or official separation till now.

so will court consider it as joint custody? or will decide the custody on merit during the trial?

Whether you have part in the custody of your child I cannot tell you. It depends on the law of the country you were living in when the child was born, obviously it was not DK.

Your wife may very well have obtained sole custody of the child in the country where she is now. Whether such a decision - if there is a such - would be considered valid in DK I cannot say without knowing which country is in question and a lot more details. Your questions should be directed to an attorney with international private law expertise.

she is in India.
and she did not file any custody suite there.
she only filed a false domestic violence case on me there...but nothing related to the custody of the child.
though, I had informed about the child abduction here in Danish authorities.
