Family member definition for visa extension

Hello all,

I have a question regarding the definition and scope for family member of EU/EEA citizen.
I'm a non EU citizen whose husband is a Dane. We're going to have my mum come over for visit and help taking care of me and the baby in September.

I would like to have her stay extended for another 3 months (valid in Denmark only). I'm wondering if she is eligible to apply for visa extention, provided she's my parent and financially dependent on both of us.

According to the visa regulations governed by EU law, she is considered a family member of EU/EEA citizen (my husband's mother in law). But i dont know if the same applies to the Danish Immigration rules on visa extention?!

Thats a good question. On nyidanmark it says, that she must be the parent of an EU-citizen residing in Denmark. And that is not quite the case, since she is your mother and not your husbands mother. So she is in fact the mother-in-law of an EU-citizen residing in Danmark.

And even that is only the case, if you and your husband was living together in another EU-country before moving to Denmark.

Maybe the best thing is to just apply for a visa extention, as soon as she has arrived in Denmark, and see what happens? If it is rejected, then she can just leave, before her visa expire, so she don`t get the 5 year quarentine.

We have the same situation. I gave birth last year and my mom came here in DK with a 90 day visa. Since this is my first baby I wanted her to stay longer so she can help me and also we we moved to a new house so theres alot of work to do. Anyway, we went to immigration and right away the clerk told us that they really dont allow visa extension UNLESS I am very sick like deadly sick or close to dying but she said we can still try, so she took my moms pass and the application. After a few days, we got a letter together with her pass that says she cant get an ext. and they gave the reason why--just what the clerk said to us before.

But it was last year, I dont know if they changed the rule. You can still try.

I guess the same will apply to my case, no extension will be granted to my mum.

Anyway, i've always thought of applying for Danish citizenship so that she would be able to have her visa extended. But now the baby is coming much earlier than planned .So i guess we will just try but will have no expectation.
