It is possible that you may be able to get a residence permit based on your job - however, it depends of the nature of your job. If you are using your Master's skills the chances are better than if you are sitting at the cash register in a supermarket.

According to Danish law you will have the Danish deferred community property. It means that you are entitled to half of your spouse's positive assets (his assets minus his debts) and he to half of your positive assets. If his debt is more than his assets you get nothing, but on the bright side you will not be burdened by his debts.

There is a special scheme called "retainment of workforce", where you can get a new and independent residence permit, if you have worker for the same employer for 12 month - in any full time job - at the time, where US inform you, your residence permit can not be extended because of your divorse. It is possible to apply for this for the first 14 days after, you receive the letter from US, that your residence permit can not be extended, and they should inform you about this in their letter.

So it seems like, you would be able to get a new residence permit. And when you have that one, you can apply for permanent residence permit Again, when you fulfill all the requirements like 3 years work within the last 5 years etc. Your pending application will be turned down, if you diverse now. Because then you dont even fulfill the conditions to keep your recidence permit, and then it can of course not be made permanent. Thats why the application form also contain all the information, which US need to decide, if you can have a temporary extension. So there are 3 outcomes of your application for permanent residence permit:

1) It is approved
2) It is turned down, but you get a temporary extension for up to 4 years instead
3) Your residence permit can not be extended

2) Will be the outcome, if you stay with your husband but some condition for permanent residence permit is not met, for example because you get sacked from your job
3) Will be the outcome, if you move away from each other, before the application is processed.
