Permanent residency as a student.

The change of rules in permanent residency has created an interesting scenario for me and may be it is possible for me to apply for permanent residency. But I have a question that still keeps me confused.

My case:
I have lived in Denmark for 5 years.

I am bygningskonstruktør (3.5 years, 210 ECTS 2007-2011)

I am currently studying civil engineering, with specialisation in geotechnology and I would graduate in Feb 2014.

I had been doing part time job for last 5 years with an average of 15 hours per week. I have been permanently employed in backery since 2008 - current.

I have finished Dansk prøve 3 all 5 moduls.

Question.
I would finish 5 year stay in august 2012. So am I eligible to apply for permanent as I am currently under education but I do not have a professional job?

Since you are still under education, there will be a "window" of time to apply from august 2012 to february 2013, since you must still be under education (or working) at the time, when the permanent residence permit can be given, and processing time is about 1 year.

Therefore if you apply later than february 2013, you must wait, until the education is finished, and you have a full time job instead.

I don`t know. Have you been to jail, or do you owe money to the danish government, which you did not pay in time? There are other requirements than study or work

I applied for permanent on 20th of August. Now I'm wondering that if I do get permanent residency, would it be from the date of application or from the date when the decision is made?

I'm told by school that I can get SU when I've permanent residency - for which I can apply after getting the permit. So does anyone know how does this work with dates and SU? I mean if I get permanent from date of application or lets say march, would I get SU's money later - like let's say in August 2013.

You can not get SU, before you actually apply for it, so I think the answer is no.

The is no point in applying for SU before you're actually eligible for it as it will only be rejected. And you will not be able to get SU any earlier when the date you apply.

So once you have the documentation in order that shows you have a permanent residence permit, then you can apply and expect a positive answer.

I think I couldn't explain my query well in previous post. I know I can only get SU once I have permanent.

To make long story short, I applied for permanent on 20th of August 2012. So if I do get permanent from what date would that permit be valid from? From 20th of August 2012 or from the day I get decision on permanent residency?

It doesn`t matter, when your permanent residence permit is valid from. Lets say you get it in may 2013, and its valid from august 2012. Then you can apply for SU in may 2013, because at that time you can prove, that you have it. If you apply for SU any earlier than may 2013, it will be rejected, because you only have a pending application for permanent residence permit, which prove nothing to SU-styrelsen.

And when you apply for SU in may 2013, you can get SU from may 2013. You can only apply for SU for the time, which lays ahead of you. That is the point, both skaanebo and I tried to make, but perhaps we were not clear enough.

currently i am on job card visa (valid until 2014) and living here with my wife and 1 child while my family(wife+child) are on dependent visa.

I am planning to apply for permanent residency permit in 2 months so my question is that do i need to submit the application for extension of dependent visa for my family along with the permanent residence application?
or
i can submit the application for extension of my family later once i get the permanent visa or before expiring the job card visa ?

it is because, its written on the permanent application form that one must submit the extension application of current residence permit along with permanent application form.

but what shall one do if he has family on dependent visa?
do I also need to submit the extension application of mine + for my family ?

Do as you are told - there is a reason why they advice you to hand in both at the same time:

you might not get the permanent, and if you haven't applied for extension of the other, you may be in big trouble!

Each person has his/her own residence permit, which might expire at different times. Your family members must each look at, when their residence permit expires, and hand in an application for extension 2-0 month before that date.

This has nothing to do with your application for a permanent residence permit.

I applied for first time residence permit in Copenhagen in August 2008 and got it in Oct 2008.

I just checked the website newtodanmark.dk that If you applied for residence in Denmark, the five years begin on the date you first applied for residence in Denmark.

So according to the above statement, Can i fulfill the requirement of 5 years of legal stay in Denmark if i apply for permanent residence permit in august 2013?

Do i also need to submit salary slip every month after handed in the permanent residence application?
or US can check itself ?

Your residence permit and the way you applied for your first temporary residence permit are used to determine how long you have legally resided in Denmark.

Residence is calculated on the following:

If you applied for residence from your home country/abroad, the five years are calculated from the date of civil registration (CPR) in the municipality of residence.
If you applied for residence in Denmark, the five years begin on the date you first applied for residence in Denmark.
If you hold a residence permit as a refugee or similar status, the five years begin on the
date on which you were granted asylum in Denmark (the date on the residence permit). "
