Married and consider to move

Indlæg af Irina1958 » 18.08.2013 20:05:28

Hello. I have been married for one year and living in Denmark, my husband is Danish and I am from Russia. I have tried to find a job all this time with no success, and we consider moving to Norway. Do I need to apply for Norwegian work permit or is my Danish permit enough to be able to work in other scandinavian countries?

I also wonder if moving to Norway for work will affect my chances to get Danish permanent residence or citizenship?

Another question is if something happens to our marriage and we get divorsed, what is the procedure and what rights would I have in Denmark as a foreign citizen? Will I be able to work or live in Denmark?

Thank you very much for your advise.
Irina

If you move from Denmark, your Danish residence permit will expire immediately.

If you move to Norway together, and your husband is working there, you will be able to use the EU/EØS (EEA) rules, since your husband will then become an EU/EEA-citizen. You will then be entitled to an EU-residence card, which gives you the right to reside in Norway 5 years, after which you will gain permanent residence right.

If you decide to move back to DK after say one year, you will again be entitled to residence card, because your husband then also will be an EU-citizen in DK. You will again get a 5-year residence card, which will lead to permanent residence right after the 5 years.

Whether you will be able to stay in DK after a divorce depends on many different things. Time in DK, your degree of integration into the Danish society (especially Danish language skills and participation in activities with Danish people, such as book/sport/culture clubs) current work, children are some of the factors which will have influence.
