First of all some basic information: I am a danish national, and my boyfriend is an Indian national.( I am writing in English so that he can "read along"). We currently live in India, have no emmidiate plans of moving to denmark, but will be spending this comming summer there. We are both over the age of 26. And, we have decided to get married.
Originally we had decided to get married here, in India (court marriage). We have all the papers ready, we really just need to file our case at the local courthouse, and wait for 30 days (as pr indian law, regarding court marriage). BUT, then I (the danish part) have been recieving a lot of concern from danish friends and family, that: IF, we get married in India, we will have a higher "tilhørsforhold" to India, as opposed to denmark, should we ever want to move more permantly to denmark. And so we have been thinking of waiting, till we get to Denmark this summer, to get married.
But reading through some of the posts, on the forums here (which have been very helpfull, thank you!) I am getting the understanding that WHERE we decide to get married really has no, or little, importance.(?) (Also since we are both over the age of 26, the question of "tilhørsforhold" is no longer an issue?)
Seeing as a wedding in denmark (most probably) will require him producing a civilstandserklæring/Certificate of No Impediment, which can be quite a process in India, it might be easier to get married here. Also since we ALREADY have all the papers required for the indian court. The only holdback really is this question of "tilhørsforhold".
So does it make a difference as to WHERE we get married, should we ever consider wanting to move to denmark?
The next question is regading this whole business of schengen visa.
India falls under the first group of "immigrant countries", where the applicant needs a letter of invitation from, or a contact person in denmark, in order to be considered for visa.
This will not be a problem, but will of course, be a bit of a logistical affair. Which is why, we were wondering if it might be much smoother for him to get the visa, if we were married?
or would that just produce a whole other set of documents required? proof that our marriage is "real" etc? or will a marriage certificate from the indian court be enough?
If anybody has any input it would be mostly appreciated.
