Hi again
I got the document of my status sent to me and translated. Really good since i couldnt get to convince my boss to give me 2 weeks off.
I am now opting for sweden. I would like to know if;
1) she will also need to translate her divorce document from danish to swedish?
2) would i need to move my address to sweden aswell? would it affect my job if they get to know i live in sweden? Do i need to tell my boss about change of address?
3) If we register marriage in sweden and she comes & hide with me in Dk while i send in application, how then would she get it since she´s not suppose to have an address here?
Please permit me with my too many questions.

How long it takes to get the marriage signed and can she come back with me in DK or would have to stay in Sweden?

You will have to contact "Skatteverket" http://www.skatteverket.se to have a "Hindersprövning" made. After that you can get married in any city hall in Sweden.

But your are running very low on time, as you will first have to get documents on your self to proofe your civil status. Depending on the language in the country you are from, you will have to have that translated. And the same goes for your girlfriend. After that the Hindersprövning as to be made, and a appointment at the city hall has to be made...That is VERY tight in 2½ weeks.

If it is legal to marry without at valid visa or residence in your home country, then you would most likely save some time in marrying there...If you cross the border to Sweden or 2-3 internal Schengen borders does not really matter...The "crime" is the same, and so would the penalty be.

Hi Soren, thanks for the link. But it seem its all in swedish and I dont seem to understand it. It seem to be talking but about skat? Or where am i to find "hinderingsprovning" on the webpage?

But she will of course in reality "turn herself in", when she apply, and must therefore face the possible consequences of her illegal stay in the form of a fine or other proportional punishment.

EU-rules and national rules are different here, because after EU-rules your wife has a right to entry and residence, even before her application for a residence card has been processed. So marrying you will in reality legalize her stay in Denmark from the very moment, you have a marriage contract in your hand.

Whereas if you were a danish citizen, she would still not have such a right, before an application for residence permit had been processed and approved. And for that reason she would need to wait somewhere outside Schengen, until that is the case.

Hi again, we still have not been able to get things done. I mean the marriage. We have been to sweden but the process was even more complicated than expected.
At the skatteverket in sweden we were asked other documents like a copy of the marriage law of our various countries, a document of my fiancé present status(eventhough we had her skillemisebevis), along with my civil status, our passports and residency. the documents were not really what discouraged us but the durability of the process. The lady told us it would take 6 week of procession and we have 4months to wed. I was like "are you kidding me or what?" We asked her why that long when we actually read its normally about a week or two or even less? She said its because we are not residing in Sweden. I asked her what it requires to be registered in sweden so we could get the documents in a shorter period? she replied that i needed to be working & have an apt or house & address in sweden to be registered. I told her i already have a job in Denmark and can´t it be a possibility to live in sweden while i work in DK but she said no. With that said, we left very disappointed and left the same minute after the talk, cancelled the hotel reservation we made.
Presently we have done some researched and got to find a priest in one church here in Dk who said he can wed us because they have the authority to wed from the government. But my worry now is;
1.)If he weds us, will it be recognised? I mean since the wedding took place here in Dk? ]1) 2.)If we succeed to get the marriage certificate, do we need to register the marriage at the kommune before sending to statsforvaltningen or just send direct with any other paper demanded?

Even if the Danish priest/minister actually should not marry you (since there is a problem with the 'legal residence'), if he does, then it is valid. As long as you are both present, and there is a person authorised to marry people, and at least 2 witnesses present, it will be recognised, not doubt about that. Never mind that it is illegal, it is without any doubt at all valid. That is how the law works in DK and in most other countries.

The priest/minister will give you the marriage certificate, but I don't know whether you have to present it to the municipality, or whether the priest/minister registers it in the system. Ask him.
