wht about housing requirement and kontant hjelp?

hi everybody ..hope ur okay ..i have 2 questions and i hope i will get answers from you guys:
1) is about housing requirement : should the spouse in denmark rent his house at least 3 years before you apply ? what if the spouse was living with his/her mother before she moves to rent her own house and 1 year before applying? will they still refuse saying that she should rent it at least 3 years?
2) kontant hjelp : if the spouse was living with her mother and had a part time job and getting only 2000 kr ..will they still refuse and consider this a real obstacle or they will not consider it coz it does not equal a salary or somehting to live on for one month?

1) No. This requirement is not directed at 'back in time'. The house/flat should be hired on a contract that must not be limited to less than 3 years from the date of application.

2) Only social benefits received on the basis of 'aktivloven' or 'integrationsloven' count as a hindrance.

Neither spouse should apply for benefits on the basis of 'aktivloven' AFTER the foreign spouse gets his/her residence permit, because it will cause that the permit cannot be extended.

hi Mh you are really such a great person coz you always devote your time to helping people here and we really appreciate this but i still do not understand this house requirement and i will tell you my case so that u will understand it and give me and answer and thanks in advance:
my wife is a pure danish and has been living with her mother and she had this address for 7 years now and the flat is about 100 M2 but she did not write her name in the contract of the house untill last febuary this year ...if i will apply for family renufication april next year..will that be a problem ?coz i did not understand still this 3 years and thanks again: will they say that she should had her name in the contract 3 years before we apply ?

@ jayoma, no, it doesn't matter how long time your spouse HAS been living in the apartment. What is important is that she will have a suitable place to live IN THE COMING 3 YEARS. She could for that matter hire a suitable place from 1st of November, day after tomorrow, as long as the contract is not limited to less than 3 years.

I think that maybe you have heard something about how long one must have been living together with the tenant whose name is on the contract, in order to gain the right to continue living in the apartment if the actual tenant moves or dies? Only in such a case has it any importance how long time has passed. If 2 persons have had 'common household' for at least 2 years the one who does not have his/her name on the contract will have a right to continue the lease, if the actual tenant moves or dies.

If the tenant is married and moves or dies, the other spouse has a right to continue the lease regardless of how long the marriage + cohabitation has lasted.
