please i need your advice very complicated story

Am a a foreign nation married to a non danish guy lives in denmark,my situation is very difficult because am under 23 and six month ,
he is from africa and having permenant residence permit in denmark what difference i just would like to know if i will be able to get a new visa to meet him in denmark
,I have got married in denmark last year, I was in
Tourist visa but the problems are once my husband tried to extend my visa I got a warning that I should live denmark in precious date but I was traveling one day before my my expires visa but I was stopped at billund airport because my ticket was through england and I didn’t

Know that I have to have a transit visa so I got back home looking for ticket so I over stay my visa for two days I mean for one and I left in the second morning but in copenhagen they wrote on my passport overstay now I didn’t try to go to denmark since may last year I left and didn’t went again but I see my husband occasionally because of our job now am a year and 5 months out of denmark in your opinion if I apply for a visa to spend the new year with my husband are they going to give me a new visa or they will stuck me …

@mh, she started a new topic because I advised her to, because her question got lost in the debate on refugees. She is new to this so please excuse her this once. Put the blame on me instead, I thought I was giving her good advice.

@By the way Marie Shoobi, fundiver did answer you on the other topic before he went on to continue the refugee discussion. He said:

Usually such a short overstay of a few days, and with a good explanation, will not prevent you from getting a new schengen visa. So just apply and hope the best. Good luck :D

@ Psalm12, as you must know by now, a question cannot be considered to have gotten lost, just because it does not get answered immediately. People must have a little patience in here.

marie shoobi HAD already posted her question i 2 forums, so posting it again is just confusing both those who might want to answer and herself - it does not become easier to find your post and responses to it if you 'clone' it, does it?

@mh, ok, yes I can see now that she also posted in Indvandrerådgivningen, but she doesn't know a lick of Danish and had some problems navigating around the site at first. Since her question was buried in all the refugee discussion, and she thought Hiren's reply to jayoma was meant for her, I advised her to start a new topic. From her viewpoint, her question got lost, but fundiver did answer her.

I apologize for adding to the confusion. I really do appreciate everything you do here.

and a special thanks for psalm112 because you provide a good and appreciated help ..and i would like to tell you that we decided to meet in other country where i can go away from the problems with visa but mey be my next visit to denmark it will be on april 2013 than til that time i will be away than dnmark for 23 months i thnk it will be more easy for me to get a visa but what can i do to re-enter denmark on july for exemple because i will be 23 and half because than i will have to apply for family reunification and than i will go back to my country waiting for the processing paper work because if i dont get a residence than i might loose everything here for nothing because here i have my own job but if i leave here and go to denmark i should make sure that i will go and stay as long i want with my husband am looking for way just not loose eveything in same time or i get F R residence than if i leave my job here mey be in the future i get other in denmark but if i leave here for 6 months and i dont get FR residence so i will have to go back to my country and than i wont find my job and nothing .....what i can do ,,can i apply for visa on april and after for another one on july or june ?because i dont know much about this ,,but i have read paper requiered UNDER F R ..thank you again for everything you do here...

You may apply for family reunion when you are 23 1/2 years old.

If you do it from where-ever you are living at that time, then when you get it you will EITHER get an ordinary Schengen-visa OR a special visa restricted to DK. Even if a person has quarantine from getting a Schengen-visa, that same person will be allowed to travel to the specific country in which (s)he is to be reunited with the spouse.

BUT ISN'T BETTER THAT I GO TO DK AND SUBMITT MY APPLICATION FROM THERE AND GET RE-ENTRY VISA BECAUSE I WOULD TRY BE ABLE TO SEE MY HUSBAND EVER 3 OR FOUR MONTHS IF IS POSSIBLE UNTILL AM 24 YEARS :D

If depends where you prefer to spend the waiting time. If you enter Denmark and apply here, when you are 23½ year old, you will need to spend 6 month in Denmark without any other rights that just staying here and perhaps making a visit to your home country after 3 month getting a return permit (tilbagerejsetil-ladelse). That’s great, if you like to spend time in Denmark just staying here. But some people might prefer to carry on with their job or study or whatever, they are doing in their home country, until they can start a more active life in Denmark.

If you apply in Denmark and then go home after 2-3 weeks to continue your work, you will not be allowed to reenter, before the application has been approved. So that is a bit useless, unless you like to visit here for 2-3 weeks anyway. In that case you might as well apply here, since that will save you money for the fee, which the embassy will charge you, if you apply there, and which is about 200 USD +.

so when am 23 and 4 months i will visit dk for three and half days but i have to apply for FR when am 23 and half so what the solution could be i cant currently get holiday for 2-3 weeks the max is 4 days every time we have different system at work,so is it better if i apply from my own country but during the processing time can i apply to visit dk even before my FR is approved? i mean i just want to try to visit dk every 3-4 months so does they give me a visit visa...i never knew about this kd of laws

i have worked for 5 years and half, and i have changed many positions, i learned languages
i have also certificates from all my previous employees and also for the languages,my husband's meets all the requierments but i dout if i really do..because i don't have really high educations..i didnt get high school diploma that time..however this is my last year in professional school than if i pass the goverment exam so i will become an accountat froom professional high school..but i am wondering in case if i dont pass my exams so i wont be gratuated and my question is if i dont gratuate is my application will turn down because i don't have high education but i have got good work experiences as constraction admin assistant and fuel assistant and waitress as well and some complexion training as office assistant ?in same time is it requiered that me and my husband to be lived togather for six months in same adress?or this is not for married coupples ?because we have lived in same adress for only three months when i came to dk but we can proof that he was taying in my country for six months so that mean no need to worry about this issues?

You cannot be issued a visa while your application for FR is being processed. But the estimated processing time for a simple case is 3 months, so changes are that you will not have this problem at all, but you will then just have to wait to apply until you are 23 years and 9 months old.
