Can anyone answer or help me?

Indlæg af Mussi » 21.11.2010 21:36:02

hi to whom it may concern: i was in london before i arrived in DK in 2004.I was on a holiday visa when i arrived here ,then apply for a study permit and start my study here at bornholm business school, i am not an EU citizen as i was born in mauritius. In london i was studying travel tourism management. It was my now x boyfriend who brought me here.So study permit approved in november of 2004 we decid eto get married in 2005 february the 14.he move to cph in 2007 june and after my working seasson finish i decide to move to cph separatly, as we were not together at least officialy.have signe the divource in janaury of 2010.Then in march the immigration took away my visas which was granted to me in 2009 januaryon a three years basis.A klage was duly written but in july of this year, 2010 i got a negative answer . My next move was to apply a working permit as i been told that , it might be an option . lately i got a denial of the permit on the ground that its does not fit what the authority has ask , like have to be employ full time prior to my application for two years. i was ask to submit my hourly record to them , which i did. was in hilton ,until lately , Radisson sas full time at some point for 6 month in 2008, and had been working two places most of the time , hilton , radisson, hilton , coppenhagen crown plaza. money wise was very good , but still it did noit make any difference.I now bwwn ask to live the country since the answer of the work permit , which i receive 7 0f this month.

From then on lots of other idea was taking into consideration what i could do so as to keep me here:

getting married within the EU law
how , but i was told thgat i could not get married now , is my visas still open untill i live the country? can i apply for a student visas here , or a visitng friends visas in sweeden , as i know a few people over. The answer from the danish work permit department have give me one month to lived dk, should i go to my country of orrigine or can i go to sweeden as one of my friend want to marry me if that can help my case?

Sounds like you have been through a lot.

Just one question: Is your friend who proposed to marry you a Swedish citizen? Or wherefrom?

My friend has been writing about it in another "tråd", but i have to understand the answer myself, thats why i ask in english.

An Italian is a EU citizen and can therefore use EU laws in any other country than her own instead of national laws if that is preferable. So they can marry and live in Denmark using EU laws.

However, in the other thread I wrote that I'm pretty sure she was born with Danish citizenship since a child will usually get the same nationality as her mother. It is also quite common to get dual citizenship by birth of parents of different nationalities. So she might have dual Danish-Italian citizenship without her knowledge if none of her parents cared to think about it. She could also have lost that citizenship again if she never lived in Denmark before she turned 21. It's a complicated world to be born by parents of different nationalities!

I feel confident she still holds Danish citizenship as she was born in Denmark by a Danish mother but she has to renew it before she turns 22 if she would like to remain a Danish citizen.

You can read more about it (in Danish) here:

skaanebo, since the Italian woman HAS lived in DK, she does not need to do anything to keep her Danish citizenship, if she has one. That only applies if she had never lived in DK.

But in this case it doesn't really matter, since it is her Italian citizenship - which she unquestionably has - that may help the couple.

As it turns out the mother isnt Danish after All. With both parents being Italian, their child is Italian too, no matter she was born in Denmark. So no worries. You can marry and use the EU laws to live in Denmark.
