Danish Taxes After Marriage - Family Reunification

Indlæg af OhKae » 03.08.2018 15:26:03

Hello everyone! This is a Family Reunification question involving taxes/Denmark. I’ve been told of some incomplete information that “something” happens after you get married that makes a Dane have to pay money that you wouldn’t have to pay as a non-married person. I’m trying to clear that up.

Question: After a non-Danish citizen (US citizen) and a Danish citizen get married, what happens to the Dane’s taxes in Denmark? Legally, what is the Dane required to do? Does he/she go somewhere in Denmark to change their filing status? Are there some sort of fees that pop out of nowhere against the Danish citizen that they suddenly have to pay now that they’re married?

Also, I’m hoping to figure out if anything is different between these scenarios. My fiancé and I aren’t married yet but I’m suppose to go to college for a year (in the US) to complete one of the new “integration requirements”. Would anything happen to his financial status/tax status if we got married now but I don’t live with him in Denmark? When I do live with him in Denmark, what should we expect to happen to his tax status then?

Thought Process:

Scenario 1: US citizen and Danish citizen get married, the US citizen hasn’t moved to Denmark yet (but will). The US citizen works in the US and the Danish citizen works in Denmark. What happens to the Dane’s taxes?

Scenario 2: US citizen and Danish citizen get married, the US citizen has moved to Denmark and they live together. The US citizen hasn’t started work in Denmark yet. The Danish citizen works in Denmark. What happens to the Dane’s taxes?

Scenario 3: US citizen and Danish citizen get married, the US citizen has moved to Denmark and they live together. They both work in Denmark. What happens to the Dane’s taxes?

(These sound like scenarios from math class. 😂)

In my experience, if you are a US citizen and your spouse lives in a different country, you choose “Married, filing single” on tax forms. However, neither one of us are that educated involving Danish taxes and marriage. In the US, I can go to H&R Block or something and ask around about my US taxes. But I have no idea what to do about his taxes in Denmark. We’re not against calling someone but I’m hoping for any information now (experiences, suggestions, etc).

Thanks in advance for any help!

The Dane goes to ‘Borgerservice’ with the marriage certificate, n s/he prudently has gotten an ‘apostill stamp’ on before leaving the States, and registers the marriage:
https://travel.state.gov/content/travel ... tions.html

Scenario 1: nothing whatsoever.

Scenario 2: the Dane reqeuest to be given the unused ‘personal tax reduction’ of the other spouse. If the US citizen moves to DK AND (important!) applies for family reunion before 31st of December 2018, the Dane will be given the unused reduction for all of 2018, which means s/he will get a tax refund paid out in 2019 - although it will not be granted until and unless the family reunion is granted. The due sum is app. 27.000 DKK

Scenario 3: nothing whatsoever. Both spouses use their tax reduction on their own income.

Thank you so much for replying!

We’ll be getting married in Denmark so everything will already be “Denmark Ready”. 😂

We won’t be applying until after I’m done with the school “integration requirement”. That won’t be until 2019. That’s why I was wondering scenario 1. We are trying to save money, so we were concerned about what would happen if I wasn’t there yet.
I wasn’t aware of the tax refund thing. I’m wondering if that refund exists every year? Like if I move there in 2019 and I haven’t found a job yet, is there still a tax refund available as long as it’s done before the end of 2019?

All Danish tax payers have a ‘personal tax reduction’ of the exact same value. It has been so for as long as I have been paying tax, only the sum increases a little, year by year. If two persons get married, but one cannot benefit from the reduction because of low or no income, the other can ask to benefit from it. It will be granted on condition of the spouses living together in Denmark.

A foreigner is considered living in DK from the day of applying for residence permit IF permit is granted. If you apply for residence permit at any time before the end of the year, your spouse will get the reduction for all if that year, and of course also for the following, until you will need it for yourself. Your spouse cannot apply to benefit from your reduction, until your permit is granted, and you have gotten your ‘cpr.number’, your Danish identification number.
