Dansk A1 delay

Indlæg af Expat85 » 21.12.2017 23:28:40

HI
I am from non EU country , i got temporary residence permit based on family reunification with my danish wife on july 2016. I have been in Denmark since september 2016.
My problem i passed the Danish Test A1 but it was 3 months after the deadline. I got a letter from immigration service stating that i passed the test and asking for the reasons why i took it late , and informing me that they will look for the reasons and my residence permit it can be revoked with some application to fill it out, that it was last july, since then i never hear from them.

i am worried when they will answer since i have to renew my residence permit in july 2018?

In case my residence permit revoked can i apply again for family reunification from here or i have to leave the country?

And i planning to travel to Qatar for work this month and come back in june 2018. Before reaching 6 months outside Denmark. Is that a problem?

Thanks

What reason did you provide for being late to take the test?

I told them that i was not ready to take test and i was improving my danish skills to pass it.
As long as i was in training periode with a company. So i missed some danish classes.

Bad excuse. I don't think they'll accept that. I believe they say it can only be extended in case of pregnancy or sickness.

Even if you appeal you'll have to leave the country. The answer from Udlændingenævnet (appeal organ) could take months. While they don't, you'll have to respect Udlændingestyrelsen's decision. If you don't, every day you stay efter the 5th February is a day you stay in Denmark illegal. And as they also might have included in that letter, ilegal stay will get you a ban from the Schengen area for years.
I recommend you to leave Denmark and wait the appeal.

Not so bad then.

You might get an answer from Udlændingenævnet before, but that's not certain.

My guess is: not positive.

The notice will be very short, maybe as little as three days.

You will have to start from scratch, applying for a new residence permit and once you got it, make sure you keep any deadlines for tests etc.

I find it curious that you already got the permit to stay, why not just pass the A1 test which seems to be the much easier part.

I have 6 in IELTS academic it cannot help my situation?
As i see now if you have a proof of english at b1 level no need for you to pass dansk A1.
what safety money is it right it changed from 50,000 to 100,000 DKK?
