Divorce and 3 years old daughter.

Indlæg af Shimanscki » 02.05.2017 16:50:13

Hey there,
I am non-european and have been married with a Danish girl for four years now, We have a three years old girl.further, I am in the fourth year of the family reunification visa.
Sadly our relationship deteriorate to a point where being together is impossible.
I have seen in other posts that, if you have a kid together you cannot be sent away on the terms that the kid should not be obligated to travel every week to see me in my home country.
But some other people I have talked mention that this is only if the kid is older than 7 years.
Can somebody explain me this a little better?

PS:Thanks for keeping this website!

Not to worry. If your child is visiting you on a regular basis, at her age minimum every other weekend (Friday evening til Sunday evening/Monday morning) and consecutive days in holidays, you will be granted residence for the benefit of your childs best interest (being able to keep contact with both her parents). You do not need to have joint custody, but of course keeping it that way does no harm, if you and your ex-to-be can cooperate.

What 'some people' get mixed up is the rule that IF the child has no contact with the parent it is not living with, and is under 6 years old (or has not had a 'normal', Danish childhood with daycare or kindergarten, spending time with other Danish children), this may block its parents application for family reunification, because the authorities will say that the child itself does not have so solid an attachment to Denmark that it should not have to follow its parent and be settled abroad in the step parent's country. This is not YOUR situation.

Thank you very much!
Even if I still don't have a job?
Through these four years I have finished my master's and I am now looking for a permanent position. Should I wait until I get a full time job?
Once again. Thank you very much!

You do not need to have a job, but you must be able to support yourself, either with money from 'a-kasse', job, or alimony from your spouse. A job need not be fulltime, and any job will do, even serving burgers at McDonald's.
