Spouse in another country while studying

Hello,

I will briefly explain my current situation and the future plans.

I am a non-EU married with a polish citizen under family reunification/EU law, both living in Denmark.

I am working full time but she isn't, as she got fired a month ago.
Yesterday I received the acceptance letter to study a master here in Denmark.

As she is not working anymore, I won't be able to apply for SU until she finds a new job.
I have enough savings to support ourselves for 6 months, but if she can't find a job until then, the plan is that she moves back to Poland and work there, while I continue my studies in Denmark.

The question is: would that be possible?
We will continue to be married and going to see each other every month. She might need to unregister herself form Denmark though.

Any suggestions for a case like that?

Your right to residence according to EU-rules is dependent of you and your EU-spouse both living in DK.

You may be able to get a residence permit based on your studies, but in such a case you will not be allowed to work full-time. You will be allowed to work 20 h/week, and full time during June, July and August.

Thanks for the reply mh.

The thing is that if I apply for a residence permit under studies, as a non-EU I would not be exempt to pay the universities fees.

As I can see in this case the best is still to cross the fingers for her to get a job soon.

Have you asked whether there is an agreement between your home country and your university or DK as such about student exchange? There might be. I, under such an agreement, could study free of tuition fees in Turkey, and Turkish students could study in DK - only 2 each year, though.
