jeg har været gift med en danske i 5 år . jeg har opflyld alle kravene så søgt jeg PUT .der gik ck 2 måneder så fik jeg et brev at min ansøgning var fuldt oplyst den (MARTS 2013). der gik 7 måneder efter fuldt oplyst dato så har jeg stadigvæk ikke hørt noget fra US .Lige efter blev vi separeret ! og nu er vi skilt .jeg har været på A kasse i de sidst par måneder .jeg har aldrig modtaget nogle form af kontanthjælp. mit spørgsmål er : hvad gør jeg for at redde situationen? tak for hjælpen

I am allowed to stay in Denmark on family reunification grounds and we managed to get a number of requirements dispensed since my wife has a child and the child has greater attachment with its father here in Denmark. I would kindly like to get information on a number of issues that are worrying me....
1. I do understand that inorder for me to qualify permanent residence I should have not recieved social help for 3 of the past 5 years....of which I do now since I am still learning danish and I can't get a job untill I am able to speak danish....
2. If I manage to get a job lets say I work for 1 year and then I study for 2years will that count as 3 years, would I be able to qualify for permanent residence in totalling up the 1 year of working and 2 years studying?
3. Would the dispensation that we got earlier apply in the requirements for permanent residence?
4. Now we have a 3 month baby if something happened, would I be sent away and never see my child again?

@mariamajken, I wish someone could answer you, but nobody knows what the situation will be by the time you apply for permanent residence. The laws have changed so many times in the past 10 years that even the Immigration office cannot keep up with them.
1. It looks like according to the current law, that you would have to wait three years after the last time you received social help to apply for permanent.
2. Under the current law, studying counts as well as work.
3. I don't see anything in the immigration website that indicates that the dispensation you received to obtain your temporary residence would also apply to permanent. I think you would just have to wait the three years and then apply. Hopefully by that time, which cannot be sooner than five years from your first application for residence, you have lived without social help for three years.
4. They can choose to allow you to stay anyway, but they can also choose not to. If something happens, when you get the letter saying they are getting ready to send you home, you have to apply for an exception. Your wife can cruise around this forum and find examples, and you can go to http://www.foreignersindenmark.dk and find other examples in English.
Nothing is certain until you get that permanent residence, and even then there are ways you can lose your residence. If we have a different parliament by that time, there is no telling what the rules will be.

In regards to our child, we both, me and my wife wish our child to have both nationalities....but we dont know which is best...could you kindly share your opionion about this.....

I really can't give an opinion on what is best for your child. What country are you a citizen of? Will your country allow your child to have dual citizenship? Will there be any difficulty obtaining that for the child?
Does your country have any requirements for citizens living abroad? For example, I am from the USA, and all US citizens must report their foreign income to the IRS, and if they earn more than a certain amount, they must pay taxes on the excess. And if they ever reinstate the draft, a young citizen could be called into the military. This could be interesting if your child is also required to serve in the Danish military at the same time.
Also, I have recently found out, if a child is born outside the United States, the fact that one parent is a US citizen does not automatically give the child US citizenship. The child would have to live in the US a certain amount of time (attachment requirement) prior to a certain age. This could also be complicated when the child grows up and begins to have children. And it makes a difference whether the child is a boy or a girl and whether the child marries the other parent of any children they have.
Does your country have any of those complications?
The main advantage would be:
Your child could travel freely between the two countries and would have the option of living in either country without having to apply for a visa or a residence permit. If your family had to move to your country (yes it could happen! - my husband and I have lived in both of our countries now!) you would only have to get a permit for your wife. If your home country is not an EU or Schengen or Nordic country this is a very great advantage. If you are an EU or Schengen or Nordic citizen, it is not quite the big deal, but it is a slight advantage.
It's a decision you and your wife have to make, and if anyone else out there knows of any advantages or pitfalls of the baby having dual citizenship or having one or the other, please bring it on!

Oh, you know what? I assumed your wife is a Danish citizen and your baby was born in Denmark, but perhaps not? If not, you would have to find out if her home country allows dual citizenship, and answer all these questions with regard to her country. And if she is not Danish, then your child is not Danish either, regardless of where the birth took place. And if the baby was born in another country, perhaps that country gives citizenship to your child, as in the USA? And would there be any corresponding obligations to that country?

Thanks for your kind information....I am from Kenya and my country allows dual citizenship....But i am not certain about Denmark in regards to dual citizenship.....but definately we would love our child to have dual citizenship.....I think it would be of great significance for her future......

Jeg regner med at blive snart skilt på grund af nogle privat årsager men er der nogle risiko, at jeg mister mit permanent opholdstilladelse i denmark hvis jeg bliver skilt med min nuværende kone.

En permanent opholdstilladelse kan kun trækkes tilbage, hvis der er begået svig/bedrag.
