Re: Family reunification under EU rules as student
Dear mh & skaanebo,
My husband is granted a short-stay visa for 35 days. He will be in Denmark next Saturday.
Could you please guide me how to process family reunification visa when he is here?
- Is it possible for us to fulfil the requirements since I am a student and have no income? (I had a job and SU but lately I couldn't make enough hours and hence no SU)
- Should we apply immediately when he arrives or should we wait a few weeks?
Thanks for your kind consideration.
Regards,
ChauLong

You need to tell more about yourself. What is your nationality? What kind of residence permit do you hold in Denmark? How long have you been in Denmark?

Hi Skaanebo,
I’m a Dutch citizen. I’m holding a resident permit in Denmark as a student. I have been here since August2019.
My husband is Vietnamese.
Is the law of 5 year ban applied to my husband’s situation in case the family reunification visa application is denied?

In order to get a residence card for your husband according to EU-rules, you need to show proof that you have sufficient means to support both of you, as neither he nor you will qualify for welfare. Also, you of course in any case need to have money to live on. The means can be any kind of legal means, savings and scholarships included.

Re: Family reunification under EU rules as student
thanks mh. Would a work contract of mine be sufficient enough to prove financial mean?
And in case the application is denied, would he be banned for 5 years?

Re: Family reunification under EU rules as student
You are completely aware that you DO NOT apply for family reunification, right?
You apply for an EU-residence card for your spouse, on the basis of YOUR being an EU-citizen living in an EU-country different from the one you have citizenship in.
Read here what your husband needs in order to apply, and how he applies (to SIRI):
https://www.nyidanmark.dk/en-GB/You-wan ... anyouapply
I do not know whether it will be sufficient to show your work contract; it must be a contract for minimum 10-12 hours per week and your salary must be at least the minimum wage for such jobs.
And no, there should be no risk of a ban.
