Divorce

Hi dear members,

I have residence permit in Denmark under EU law. It is been more than a year now.
We are in the middle of the divorce processes and we have no kids.
I would like to know what happens if we get divorce? We are both South American but she is a danish citizen.
Do I have to leave Denmark? Or there are possibilities to stay in the country?

Hope there is someone that can give an insight into the situation!

How long have you been married?

If you have been married for more than three years, you will have a right to stay in DK, on the condition that you are self-supporting, that is: working or running your own business, or have other legal means to support yourself (spouse alimony can be such means).

Yes it has been more than three years since we are married.
What happens if I lose my job then?

If you are member of ‘a-kasse’, the unemployment pay from it is ‘legal income’. If you are not, then losing your job can mean losing your residence right.

I am a member of a-kasse and I recevied a-kass 4 months last year. But since I heard the law about a-kasse changes from 2019 and for me to get a-kasse I need to have lived here 7 years of the last 10-12 years, that means I wont get a-kasse anymore, right?

Your rights are derived from your EU-spouse, and in my opinion (as a lawyer, but not expert on EU-law) they will continue to be so. EU-citizens do NOT need to have lived in DK for 7 years in order to get a-kasse, so you ought not to have to either. But as I am not all that up-to-date on EU-law and do not live in DK, I would advice you to find a ‘retshjælp’ (legal aid) office near you, and ask there.

I wish to ask, if you were married to an EU citizen, and after divorce, you remarry a non EU citizen,can they be granted residence under you. Thanks

Depending on whether you fulfill the conditions for foreigners - you yourself enjoy derivative EU-citizen rights, but you don’t have EU-citizenship and can only get family reunion if you fulfill the conditions shown here:

Hello

Can i please know how to apply for the self supporting condition.

I am married since more than 3 years, and have a stable job since more than 2 years, and will soon get a divorce, i am not european, and my husband is danish, how can i do to still be able to stay in denmark after a divorce.

Are you not asking in this thread because you have EU-residence? (Danes can be 'transformed' into EU-citizens).

If not, it would be better if you start your own thread.

And whether you are the spouse of an EU-citizen or not, after divorce you will receive a letter from the Immigration Office, where they tell you that they intend to revoke your residence permit, and ask whether you can give any reason why they shouldn't. You then reply ASAP that you have a job, and think they should consider that as a valid reason for allowing you to stay.

If you are the spouse of an EU-citizen, you will get to stay in DK.

If you are not, then it is not certain, it will mainly depend on:
- whether you are a Turkish citizen (special rules apply)
- how well paid your job is, and/or
- whether you have special skills.
