Hello Everyone,
Im writting this in behalf of my sister. I hope to get some information.
My sister (non eu) , She work as aupair here in denmark for 2 years now. She is planning to come back home in Philippines since the aupair visa expired this coming Aug 26, 2014.
But her Swedish BF wanted her to stay with himin sweden and marry her.
Question:
1. Is it allowed for my sister to stay in Sweden even though she dont have a visa after aug. 26, 2014?
please let me know your knowledged regarding this. And some good idea. Thanks

No, this will not be possible. She has to go back to her home country and from there she can apply for a residence permit in Sweden on the basis of intending to live with her Swedish boyfriend. You can read more on www.migrationsverket.se

If she should happen to be able to prove that she is pregnant with her boyfriend before the visa expires, she may apply while in Sweden. But that would only be possible if she IS pregnant...

My sister told me that they applied already a visa but they havent heard any reply yet if they got a YES or rejected.
Is she need to go home to Philippines while waiting for the result?
Because here in Denmark, they have a procedural visa, that the applicant allowed to stay during the process. How about in Sweden? Do they have also a procedural visa?

As the main rule: No they dont. But as mh explains, exceptions CAN sometimes be made, eg. if the cupple has a child.
