EU citizen working in DK and Moroccan girlfriend
EU citizen working in DK and Moroccan girlfriend
Can she come to live with me in Denmark? What needs to be done? I guess if we get married, it should be straightforward (she's not 24 yet, so we would have to marry in my home country). Is it possible without getting married, yet? I can practically support both of us here with my job, I'm not sure what's the requirement to officially be able to support both of us, if there's such thing. Naturally it would be preferred if she could work here and of course I'm looking for a longer term solution than the 90 day tourist visa alone. Thanks
Re: EU citizen working in DK and Moroccan girlfriend
Yes she can come live with you in Denmark as you are an EU citizen in another EU country than your own.
You either have to be married or have to have been living togerher for 1½-2 years.
You can read all about what the requirements are and how she can apply to live with you in Denmark

Re: EU citizen working in DK and Moroccan girlfriend
As long as you are both at least 18, there is no problem to marry in Denmark.
Re: EU citizen working in DK and Moroccan girlfriend
Oh, i read somewhere that to marry a foreigner in Denmark you both have to be over 24. So the way to do it is to invite her as a tourist, get married here and apply for family reunification, right? Or will there be an issue that she used her tourist visa with the intent to stay? Thanks a lot for the quick reply
Re: EU citizen working in DK and Moroccan girlfriend
She should not say that she intent to stay if she applies for a turist visa. Instead she will have to prove that she has reason to return to Morocco (she has a home there, she studies at the university, she has a job and has been granted vacation by her employer, etc.)
If you are married before she comes to Denmark, she can apply for visa on the grounds of her marriage to an EU citizen living in another EU contry.

Re: EU citizen working in DK and Moroccan girlfriend
Yes, she won't say it before, i was just wondering if they can claim she lied about returning and it would cause trouble
Re: EU citizen working in DK and Moroccan girlfriend
no. She is allowed to change her mind once she is in Denmark.

Do be sure that she has all necessary documentation for getting married, and that it is in English (not so many in DK knows French anymore) and has been legalised.

You can find information about what will be needed to be married in Denmark when you both are foreigners at https://familieretshuset.dk/en/your-lif ... -marriages
Re: EU citizen working in DK and Moroccan girlfriend
Yes, i was aware some documents will be needed, but didn't check yet. Thanks a lot for the help
Re: EU citizen working in DK and Moroccan girlfriend
I eventually got to this part: ...If I'm not a Danish citizen or refugee: The spouse living in Denmark must have passed the Danish-1 test [Prøve i Dansk 1],
So that's a definite requirement for the family reunification, right?

NO, not when you are a citizen of another EU country than Denmark.
There are only 3 requirements for you

- The sponsor’s independent grounds for residence must still be current. The sponsor’s independent grounds for residence under EU rules can, for example, be as a worker, self-employed person, person with sufficient funds or the like, but not as a family member whose grounds for residence are derived from another person.
The sponsor must have established genuine and effective residence in Denmark
The marriage, registered partnership or long-term co-habitation must be genuine
Re: EU citizen working in DK and Moroccan girlfriend
One more question that I'm not 100% sure about. Would she then have "a residence permit with the possibility for permanent residence - noted as “MMF. varigt ophold” on the back of the residence card"? Which means she could attend a university for free. The would definitely make our future here more promising
Re: EU citizen working in DK and Moroccan girlfriend
No idea. She will have to ask the institution she want to study at what the rules are.

Re: EU citizen working in DK and Moroccan girlfriend
If you have residence card on the grounds of family reunion, it IS a residence right that can be made permanent, and an EU residence right can likewise become permanent, but I do not know whether an EU residence card has that annotation.
But: Spouses of EU citizens have the same rights as their EU citizen spouse, on the same conditions, so your spouse should not have to pay tuition fees, since you would not have to. Just like my husband did not have to change the licence plates on his car, because I as the EU citizen would not have had to if the car had been mine, because our stay was time-limited.
